Who May File for Their Divorce Papers as Uncontested?
The uncontested divorce was designed for everyone that wishes to file divorce papers for a dissolution of marriage and can do so by resolving any disputes prior to reaching the court. In order to qualify as an uncontested divorce the parties must meet all of the few requirements listed below. If you and your spouse can agree on the following few items, you should be able to file your own uncontested divorce forms using the divorce forms provided by us and receive your uncontested divorce within 30 days. If you and your spouse cannot agree on every aspect of ending the marriage, it is recommended that you seek legal representation from an attorney.
Uncontested Divorce Requirements
- You must meet the uncontested divorce papers residency requirement twelve months.
- Both of you must agree on all aspects of ending your marriage.
- The wife must not be pregnant.
- You must know the whereabouts of your spouse, as he or she will need to sign the documents. He or she will not need to appear in court, however, you will need to be present.
- There are administrative fee’s that must be paid directly to the court at the time of filing and the Sheriff’s charges must be paid in advance. Generally these fees are approximately R150.00
